Homeowners foreclose on Bank of America, yep you read it right!

I was doing some catchup reading in my email and came across this and it just made me giggle and see a spark of hope, that people are beginning to fight back!  I would have loved to have been there to see this whole thing go down in person, it's about time, " We the People" take back the power from the Banksters!  Enjoy :o)

(NaturalNews) In a role reversal that would bring satisfaction to many a struggling American, a foreclosed couple foreclosed on a Bank of America branch last week.

Warren and Maureen Nyerges, of the Naples, Fla. area, bought a home with cash in 2009, yet in 2010 Bank of America tried to foreclose on them. It eventually took a court intervention to remedy the situation. (http://www.npr.org/blogs/thetwo-way...)

In December 2010, a judge said that the bank wrongfully tried to foreclose on the Nyerges home (http://www.digtriad.com/news/waterc...) and ordered the bank to pay the couple $2,500 for the attorney fees resulting from the mess. But months later, the bank still had not paid up.

The Nyerges hired a lawyer, who pursued a levy, and Friday, June 3, it all came to a head. The lawyer came to the local Bank of America branch with the sheriff, the media and a moving truck.

"I'm either leaving the building with a whole bunch of furniture, or a check or cash or something," the attorney, Todd Allen, said.

Sheriff's deputies entered the branch shortly after 9 a.m., and presented the bank manager with a court writ and the choice familiar to so many former homeowners in America: Pay the money or prepare to lose possessions.

Allen ordered the deputies to take photocopiers, desks, computers and whatever cash was in the drawer to settle the debt. The bank manager on duty was "visibly shaken" he said.

"Having two sheriff's deputies sitting across your desk and a lawyer standing up behind them demanding whatever assets are in the bank can be intimidating, but so is having your home foreclosed on, when it wasn't right," Allen said. "They've ignored our calls, ignored our letters, legally this is the next step to get my clients compensated."

The Nyerges submitted multiple pleas for the money owed directly to the bank many times.

"I talked to branch managers, I called anyone who would listen to me," the couple said. "And I wrote a certified letter to the president (of the bank). No response, nothing."

After about an hour of being locked out of the bank, the bank manager relented and handed Allen a check for the legal fees.

"As a foreclosure defense attorney this is sweet justice" Allen said, because this situation is just a symptom of a larger problem.

Hi Kelle,
I loved the story and hope to see alot more like it. Our house loan was sold to BOA but I've never been late with the payment. Also used that bank when living in CA so have funds in there.....ND banks are local and much more personalable. Guess I need to transfer over.
Are you still having rain and grey clouds? When will we ever come out of this gloom? Have a great day and keep a smile on your face....love you guys.

Me too and these banksters have far, far to much power. The banking industry is the largest ponzie scheme there is in the history of our nation. We only deal with banks on an "as needed basis" We've tried to get away from them as much as humanly possible, sadly the world revolves around banks.*sigh*

It's rainy and gloomy again today*sigh* We did have three days into the 70's and got about half of the garden planted, but still have squash, carrots, bush beans, corn and some grains to plant, it's just to wet and cold.
It doesn't help that Mike's been working long, long hours( from 6am to as late as 9pm) and now today he's up on E. Boulder and will be gone overnite. Cortney and I are so far behind on yard and garden, because when it finally dires out we have to almost swath the yard, then before we can do catch up on weeds and cleaning out flowerbed and planting, it's rainy again.
Add to this the river being extremely high and there has been little snowpack melt yet, trecking to and from the city for Cortney's driver's ed and Dr. appointment( check up and physical only, no worries) We're all feeling a bit overwhelmed and crabby. Mike gave us something to look forward to when he comes home tomorrow night, as a celebration for passing her drivering portion of her test( she will we know :o) ) she gets to pick where we'll take her out to supper!

Great story. Banks are now slave owners and glorified sharks, and people need to get smart about using banks anymore.

Oh she will do it....I'm praying all day for her to have nerves of steel....I know she knows all the rules and regulations, now she needs to put them to work...Go Cortney go....love you.

This is a very impersonal and scarey Bank. They did a bad # on my Asian neighbors. These are very decent people, well educated and never defaulted one payment. They were going to retire from Ill to Houston here and paid over $100,000 into this home already..down from ours. Their loan got *Mixed up* by accident with some modified loans and their House went into foreclosure. They sold everything for about nothing and went back to Ill. Im so thankful their daughter and Son in Law are lawyers and are on the case making a case against BOA. This is one disgraceful Bank. My husband and I have had dealings with them briefly and found them to be underhanded!

I heard about this too and was very proud that those people did what they did. Awesome. BTW, the bright blue on the dark green background is very hard for me to read, just sayin'.

I was listening to Dave Ramsey (personal finance guy) on the radio while in the garden the other day and heard him talk about this bank fiasco...I'll tell you, the story sure put a big smile on my face.:)

I saw this on TV the other day and cheered outloud!! Esp. since it was Bank America! They can be real ass-holes! So glad they had the gumption to do what they did. On TV it showed the moving van backing up to the Bank entrance...too bad they didn't start loading up!! ...debbie
